1.INTRODUCTION
1.1 Purpose
T.R. Ministry of Labour and Social Security (“Data Controller” and/or “Ministry”) aims to process your personal data in accordance with the Personal Data Protection Law No. 6698 (“Law”). This disclosure text is in accordance with Article 10 of the KVKK and the Official Law No. 30356 dated March 10, 2018. Procedure to be followed in fulfilling the obligation to inform published in the Gazette. In accordance with the Communiqué on Principles, this text has been prepared for the purpose of informing the relevant persons regarding the processing of personal data collected in the legal entity of the Ministry, its relevant directorates and units and service centers.
In this context; The Information Text on the Protection and Processing of Personal Data has been prepared in order to inform and enlighten data owners in accordance with the KVKK (Personal Data Protection Law - PDPL) and relevant legislation.
Personal data may be collected by the Data Controller through any audio, written, visual or electronic methods.
We hereby inform you that the Ministry, as the “Data Controller” agent may;
- Process your personal data in a limited and proportionate manner, within the framework of the purpose that requires their processing and in connection with this purpose.
- record, store, preserve, reorganize, share your personal data with institutions that are legally authorized to request it, or transfer, assign, classify your data to third parties at home or abroad, in accordance with the regulations regarding PDPL. The Ministry may also process the concerned data in the ways specified in the Ministry’s Personal Data Protection and Processing Policy and the Special Personal Data Protection and Processing Policy.
2. Collection and Procedure of Personal Data
The Ministry will process your personal data in accordance with the conditions and purposes set forth in Articles 5 and 6 of Law No. 6698, as set forth in this text, and also as described in the relevant policy documents. Your personal data collected and used by the Ministry are, in particular, as follows:

Your personal data is collected through all kinds of information and documents submitted to the Ministry and camera recordings kept in all locations belonging to the Ministry.
3. Purposes of Processing Personal Data and Legal Reasons
Your Personal Data may be processed by the Ministry for the purposes specified below, but not limited to these.
Your Personal Data (religious information, health data and visual data, which are considered as special personal data but included in identity documents, come indirectly from the copy of the identity card and/or the photocopy of the driver's license) are processed to the extent required and permitted by the Personal Data Protection Law, the Public Procurement Law, the Trade Unions and Collective Bargaining Agreements Law, the Occupational Health and Safety Law, the Labor Law, the Social Insurance and General Health Insurance Law, the Turkish Code of Obligations, the Turkish Commercial Code, the Attorney's Law, the Turkish Civil Code, the Electronic Communications Law, the Enforcement and Bankruptcy Law, the Regulation on Health and Safety Measures to be Taken in Workplace Buildings and Annexes, the Social Services Law, the Pension Fund Law, the Law on Access to Information, the Civil Servants Law, the Public Financial Management and Control Law and, but not limited to, other legislation provisions;
- Legal follow-up, legal reporting, auditing, carrying out legal transactions regarding cases to which we are a party,
- To carry out the necessary work to ensure that our citizens benefit from the services provided by the Ministry,
- To be able to create and manage the records of our citizens,
- To be able to conduct evaluation and analysis studies regarding our citizens within legal limits,
- Ensuring the implementation of the Ministry’s human resources policies,
- Ensuring the legal and commercial security of the Ministry,
- Planning of the works carried out directly or indirectly by the Ministry,
- Determining and implementing the strategies of the Ministry,
- Conducting research studies and analysis, including surveys, to measure the satisfaction of our citizens with the services provided ,
- Resolving our citizens' complaints regarding the service provided and processing their data access or correction requests,
- Creating and updating efficiency reports by obtaining information about citizen-based developments in the service provided,
- Facilitating the social media sharing function within the scope of the service provided,
- Monitoring and execution of legal processes and communication processes with other official institutions and organizations,
- Planning information security processes, creating and managing information technology infrastructure,
- Carrying out risk management, ensuring business continuity, monitoring contract processes or legal demands,
- To be able to carry out the activities and procedures of the Ministry,
- Conducting relations between our citizens and the Ministry and monitoring corporate governance activities,
- Carrying out financial, accounting and financial transactions and carrying out risk management by the Ministry,
Your personal data will be stored for a reasonable period of time specified in the relevant legislation or until the purpose of processing ceases to exist and, in any case, for the duration of the legal limitation periods.
4.Transfer of Personal Data to Third Parties
4.1. Transfer of your Personal Data to Third Parties within the Country;
Your personal data may be shared and transferred by the Republic of Türkiye Ministry of Labor and Social Security with direct and indirect solution partners , event companies , digital agencies, call center service providers, audit companies, banks, financial institutions, consultancy firms from which support is received in the fields of law, tax, etc., insurance companies and other solution partners, third parties from which external services are received in the fields of storage, archiving, information technologies (server, hosting, program, cloud computing), security, call center located in the country, legally authorized public institutions and organizations and private persons in accordance with the personal data processing conditions and purposes specified in Article 8 of the Law on the Protection of Personal Data.
4.2. Transfer of Your Personal Data to Third Parties Abroad
In accordance with Article 9 of the PDPL, personal data may be transferred abroad in the following cases:
- The explicit consent of the relevant person is available,
- In data transfer to countries with sufficient protection (countries deemed safe by the Board), the conditions specified in the Law (conditions specified in the second paragraph of Article 5 and the third paragraph of Article 6 of the Law),
- In data transfer to countries where there is no sufficient protection, the conditions specified in the Law are present (the conditions specified in the second paragraph of Article 5 and the third paragraph of Article 6 of the Law), the written commitment of sufficient protection by the data controllers in the foreign country and the permission of the Board.
If the Ministry transfers data to third parties located abroad and who are data controllers, the Personal Data Protection Authority determines the minimum conditions in accordance with Article 9 of the PDPL. In the case where both parties are data controllers, an undertaking signed by both parties is submitted to the Personal Data Protection Authority. The data transfer in question will be made with the approval of the Personal Data Protection Authority and the Authority will not transfer data to the third parties in question without this approval.
5. Rights of the Data Subject
As per Article 11 of the PDPL, you have the right to request the following issues regarding your personal data by applying personally to the Ministry:
- to learn whether your personal data is being processed,
- to request information regarding your personal data being processed,
- to learn the purpose of processing personal data and whether they are used in accordance with their purpose,
- to learn the third parties to whom your personal data has been transferred domestically or abroad,
- to request correction of your personal data if it is processed incompletely or incorrectly and to request the deletion or destruction of your personal data in accordance with the provisions of the Law on the Protection of Personal Data No. 6698 and the Regulation on the Deletion, Destruction or Anonymization of Personal Data, to request correction of your personal data that is processed incompletely or incorrectly and to request notification of the deletion or destruction of your personal data to third parties to whom the personal data is transferred,
- to request that your personal data be deleted, destroyed or made anonymous if the reasons requiring the processing of your personal data are eliminated and to request that the action taken within this scope be notified to third parties to whom your personal data has been transferred,
- to object to the emergence of a result to the detriment of the data owner by analyzing your processed data exclusively through automated systems,
- to request compensation for damages in case you suffer damages due to the unlawful processing of your personal data,
You may submit your requests arising from the PDPL by filling out the “Data Subject Application Form” in writing or by other methods determined by the Personal Data Protection Board. You may deliver the Application Form to the Ministry by hand with documents proving your identity, send it to csgb@hs01.kep.tr via KEP , or to “Emek Mahallesi, Naci Ayvalıoğlu Caddesi No:13 Pk: 06520 Çankaya / Ankara” via post or notary. In accordance with Article 13 of the PDPL, the Ministry will finalize your application requests free of charge, depending on the nature of the request and within 30 (thirty) days at the latest. However, if the transaction requires an additional cost, you may be charged the fees in the tariff determined by the Board. If the request is rejected, the reason(s) for rejection will be notified to you in writing or electronically with the reasons.
